A Texan is suing his date for the cost of a cinema ticket after she upset him by sending a bunch of texts to a pal while watching Guardians of the Galaxy Volume 2.

Vezmar claims that the woman "activated her phone at least 10-20 times in 15 minutes to read and send text messages".

After suggesting that his date could go outside to text - she did, but never returned.

According to the paper, Cruz paid Vezmar back the money Thursday, May 18 after the producers of the television show Inside Edition asked her to meet Vezmar outside the movie theater.

Mr Vezmar asked her to stop but she refused.

"It was kind of a first date from hell", he told the newspaper. He also claims that his date ignored his requests to stop texting during the show.

"I had my phone low and I wasn't bothering anybody‚" she is quoted as saying.

"I am fully aware of the weirdness of this situation", Vezmar told KVUE.

However, he said, "To save the time of the courts, the Alamo is willing help put this to bed and hereby offers Vezmar a gift certificate in the amount of $17.31 for his next cinema outing".
