Wisconsin wants 'Making a Murderer' inmate to stay in jail

The Wisconsin Department of Justice asked the Seventh Circuit Court of Appeals Monday to deny Dassey's immediate release, or at least to keep Dassey behind bars until the full court rules on the state's appeal of Dassey's overturned conviction.

The federal appeals court in Chicago on Thursday upheld a lower court's ruling from a lower court overturning his conviction. The panel also ordered Dassey to be released if state attorneys decided not to retry him within 90 days.

Dassey's lawyers go on to say, "Indeed, the State can no longer credibly argue that it is "likely to succeed on appeal". when it has not prevailed against a habeas petitioner in either the district court or the court of appeals but files a petition for en banc rehearing nonetheless".

Monday will decide whether Brendan Dassey will be released from prison or if he'll stay behind bars.

Brendan Dassey was sentenced to life in 2007 in connection with Teresa Halbach's death.

Viewers were almost unanimous in the opinion that Dassey was innocent and his confession had been coerced by investigators.

Dassey and his uncle Steven Avery became the subject of Netflix's "Making a Murderer", which first launched on the streaming site in December 2015. She authored the court's 2-1 opinion. "We continue to send our condolences to the Halbach family as they have to suffer through another attempt by Mr. Dassey to re-litigate his guilty verdict and sentence". Back in August of 2016, a federal magistrate judge ruled in Dasseys' favor, agreeing that his confession to the murder had been coerced and was therefore inadmissible.

Unfortunately, this ruling does not necessarily mean that Dassey will be immediately freed. The Constitution is not offended by such police tactics as encouraging the subject to tell the truth, bluffing about what the police already know, or confronting the subject with what the police know from physical evidence. As of last Friday, he had "lost 4,132 days of his life to prison", they pointed out.
