US Gov't Court to Block Travel Ban Ruling

In response to a Hawaii federal judge's order last week, the department instructed USA diplomats to consider grandparents, grandchildren, brothers-in-law, sisters-in-law, aunts and uncles, ?nephews and nieces and first cousins to meet the criteria for applicants from the six countries to receive a US visa. "That simply can not be", Judge Derrick Watson wrote in his decision on July 14. But grandparents, grandchildren, aunts, uncles, nieces, nephews, cousins, brothers-in-law and sisters-in-law are excluded.

In a court filing on Friday, the administration asked the justices to overturn Thursday's decision by a USA district judge in Hawaii, which limited the scope of the administration's temporary ban on refugees and travelers from six Muslim-majority countries. He also called the original policy the "antithesis of common sense".

The U.S. Justice Department on Friday asked the Supreme Court to block a judge's ruling that prevented President Donald Trump's travel ban from being applied to grandparents of U.S. citizens and refugees already being processed by resettlement agencies.

"We are processing visa applications for nationals of the six affected countries as directed by the Executive Order and to the extent permitted by court decisions", the official said.

"The district court has issued decisions that are entrusted to the Executive Branch, undermined national security, delayed necessary action, created confusion, and violated a proper respect for separation of powers", Attorney General Sessions added.

Sessions, however, said that "the district court has improperly substituted its policy preferences for that of the Executive branch, defying both the lawful prerogatives of the Executive Branch and the directive of the Supreme Court".

But the Trump administration got to decide what that relationship meant exactly.

Watson declined to put his ruling on hold pending appeal, meaning it went into effect immediately. "Treating all of these relationships as "close familial relationship (s)' reads the term 'close" out of the Court's decision". Last March, just hours before an amended version of the ban was scheduled to take effect, Watson granted a temporary restraining order enjoining the Trump administration executive branch from enforcing or implementing two key sections of the executive order across the nation. He ruled for the state late on Thursday.

The state of Hawaii has until noon Tuesday to respond.

"Posts should therefore reconsider and readjudicate a visa application refused exclusively based on the E.O.in which the applicant contacts the consular section claiming to have a close family member that exempts them from the E.O. on the basis of the new guidance", according to the cable that Reuters obtained.

The Supreme Court was already slated to take up the case in October, but the Justice Department says it should step in earlier and "clarify" how far Mr. Trump can carry the travel ban now.
