Nevada Wholesaler Steps Up to Restock Dispensaries

Unlike other legal pot states, Nevada's law dictates that only alcohol wholesalers can transport the drug from growers to storefronts for the next 18 months.

The 47 retailers now licensed to sell recreational pot previously operated as medical marijuana outlets, which were allowed to move products between cultivators, manufacturers and retail store fronts.

But representatives of several of the 47 retailers now licensed to sell recreationally testified before the tax panel Thursday their shelves are almost empty because there's no distribution mechanism that allows them to restock.

The state of Nevada took steps this week to solve dispensaries' marijuana shortage.

The lawyer for a group of Nevada alcohol wholesalers suing the state over marijuana distribution licenses says an emergency regulation state tax commissioners are considering to free up more licenses would be just as illegal as an earlier one struck down by a Carson City judge.

But she said it's too soon to tell if Crooked Wine of Reno and Rebel Wine of Las Vegas will be able to handle the demand statewide.

He said police are determined to "bring each and every one of these lost boys home to their families, one way or another". Police said the victims were buried in a 12-foot grave on the suspects' family's large estate in Solebury Township.

While the state had given alcohol distributors sole rights for the first 18 months of sales, a court battle and bureaucracy kept any licenses from being approved for almost the first two weeks. Kevin Benson stopped short of threatening another lawsuit, but said he's convinced the emergency rules would be invalid.

"There aren't enough alcohol distributors serving that market", Riana Durrett, executive director of the Nevada Dispensary Association, said at a hearing on the matter Thursday, the Los Angeles Times reported from Las Vegas.

Tax Commission member Thom Sheets said the answer was clear to him when no distributors had been approved.

Nevada Department of Taxation spokeswoman Stephanie Klapstein said Thursday a license has been granted for an alcohol wholesaler — Crooked Wine Co.

The Nevada Tax Commission unanimously approved emergency regulations, opening up the possibility for more businesses, like marijuana dispensaries, to get licensed to transport marijuana and start moving their own products again. Initially great news for the state's coffers - raising approximately $500,000 in new tax revenue - the state's lack of planning for adequate distribution quickly created a conundrum for dispensaries - a lack of cannabis products.

Nevada voted in favour of legalising recreational use of marijuana in November, following similar moves in several other states. Dispensaries can only obtain marijuana from authorized distributors, however, and a provision in the law precludes regulators from letting anyone outside the alcohol industry transport pot until 2019. In California, third-party distribution was mandatory under a medical-marijuana regulation bill signed by Gov. Per the new regulations, Nevada's Tax Commission will now allow the distribution of recreational products by companies not related to the alcohol industry.
